It wasn’t paved with standard recommendations or routine arguments.
It was one of those rare cases where the court made a bold decision: to override the official Custody Committee’s report—in favor of what truly matters: the children’s future.

The case began with a father’s request to revoke the mother’s custody after it became clear that she was sharing her home with an unrelated man—a living situation that raises serious concerns about the emotional and ethical environment surrounding the two children.
Despite this, the court of first instance dismissed the claim without investigating the full reality of the children’s living situation or addressing the critical questions it raised.
But we didn’t stop there.
We submitted a detailed memorandum to the Court of Appeal, backed by documents and legal reasoning, arguing that the presence of an adult male in the same home poses a direct threat to the psychological and moral stability of the children, and violates the standards upon which custody in the UAE is based.
In response, the court appointed the Custody Committee to conduct a thorough field report.
Although the report did not recommend removing the children from the mother’s custody, we remained focused on the heart of the matter: the children’s well-being must come before all else—even official recommendations.

In a move few expected, the Court of Appeal ruled against the committee’s findings.
Yes, the court acknowledged the report—but chose to prioritize the facts and the children’s best interest, declaring that a home shared with an unrelated man was no place to raise them.
As stated in the judgment:
❝…Since it has been proven to the Court that the mother is residing with a non-relative man in the same residence, which poses a direct negative impact on the children’s upbringing and psychological stability, the Court finds that their best interest is no longer served in her care. Therefore, her custody is revoked.❞

This ruling isn’t just a legal victory for the father—it’s a rare and powerful example of a court placing substance over form, and real-life concerns over procedural comfort.
